These Terms of Use govern the conditions for accessing and using the MyPetAlive Platform, constituting a contract between the Owner and PET BIO ID LTDA. Use of the Platform expressly indicates that the Owner has read, understood and agrees to all terms and conditions set forth herein and with applicable legal provisions.
1. Parties and Subject Matter
1.1 Parties
Platform: PET BIO ID LTDA ("PetBioID" or "MyPetAlive"), a private legal entity registered under CNPJ/MF No. 35.816.619/0001-53.
Owner: An individual 18 years of age or older, fully capable, who accesses and uses the MyPetAlive Platform.
1.2 Definitions
Platform: System consisting of web and mobile application, available for iOS and Android, at mypetalive.com, owned, operated and managed by PetBioID.
Digital Pet ID: Digital pet identification document, generated by the Platform in PDF format, containing registration data, biometric identifier and authentication QR Code.
Biometric Data: Information extracted from Pet photographs for unique facial identification purposes.
1.3 Subject Matter
The MyPetAlive Platform offers the Owner a private biometric identification system for pets, comprising:
Pet registration with identification data
Facial biometric capture of the Pet via web or mobile app
Digital Pet ID issuance in PDF format with unique QR Code
Pet public profile accessible via QR Code without login
Lost pet reunion system
2. Agreement
This instrument governs the conditions of use of Platform services. Use of the services offered through the Platform expressly indicates that the Owner agrees to all terms and conditions contained in this instrument and with applicable legal provisions.
BY ACCEPTING THE TERMS OF THIS INSTRUMENT, THE OWNER EXPRESSLY AUTHORIZES THE PROCESSING OF THEIR DATA IN ORDER TO ENSURE THE MAINTENANCE AND PROPER PERFORMANCE OF PLATFORM FEATURES.
If the Owner does not agree with the provisions of this instrument, they should not access, view, download or use in any way any page, content or service of the MyPetAlive Platform. These Terms are available for reading at any time at mypetalive.com/terms-of-use.
3. Who We Are and What We Do
PetBioID provides, through the MyPetAlive Platform, a private and independent biometric identification system for pets. Through the Platform, the Owner can register their Pet, submit photographs for biometric processing and obtain the Digital Pet ID, a private identification document with a unique QR Code.
Registration on the Platform is a private service, intended exclusively for pet identification and reunion. The registered data is used exclusively for the provision of contracted services, under the terms of this Policy and the Privacy Policy.
The Digital Pet ID is a private identification document, issued by PetBioID, without value as an official document before government agencies.
4. General Conditions of Use
The Owner agrees to use the Platform features in good faith, in accordance with applicable law, morality and good customs.
The Owner expressly acknowledges that, through this instrument, they receive from PetBioID a non-transferable license to use the Platform, with sublicensing prohibited, for use in national or foreign territory, for as long as adherence to this term lasts.
The Owner is solely responsible for the security of their password and the use of their Platform account. In case of loss or unauthorized access, the Owner must immediately notify PetBioID at contact@petbioid.com.
Owners must not use the Platform for any illegal, defamatory, discriminatory, abusive, offensive, deceptive purposes or that may harm PetBioID, other users or third parties.
Under no circumstances shall PetBioID be liable for any damages suffered by Owners due to temporary unavailability of the Platform.
5. Registration
The services offered by PetBioID are available to fully capable individuals. To register on the Platform, the Owner must provide:
Full name
Government ID (optional)
Cell phone number
Full address
It is the Owner's exclusive responsibility to provide, update and guarantee the accuracy of registration data. PetBioID reserves the right to use all valid and possible means to identify its Owners, as well as to request additional data and documents to verify the information provided.
If a registration is deemed suspicious of containing erroneous or false data, PetBioID reserves the right to suspend, temporarily or permanently, without prior notice, the Owner responsible for the registration.
Only one account per person is permitted. The Owner will access their account via login and password, agreeing not to share these credentials with third parties.
The Owner agrees to immediately notify PetBioID of any unauthorized use of their account. Under no circumstances will assignment, sale, rental or other transfer of the account be permitted.
6. Features
The MyPetAlive Platform offers the Owner the following features:
Complete Pet registration with identification data
Facial biometric capture of the Pet via device camera
Digital Pet ID issuance in PDF with QR Code
Pet public profile accessible via QR Code without login
Lost pet reunion system
Access to free and premium service plans
PetBioID may, at any time, without prior notice or indemnity, edit and/or remove existing features, as well as add new features to the Platform. All features are available at mypetalive.com.
7. Plans and Payment
7.1 Freemium Model
The MyPetAlive Platform operates on a freemium model, with the following modalities:
Basic Plan (Free): access to essential registration, biometrics and Digital Pet ID issuance features, with limitations defined by PetBioID.
Essential Plan: $9.90 per year, with access to intermediate features.
Premium Plan: $14.90 per year, with full access to all Platform features.
7.2 Payment
Paid plans are charged annually, via a single payment by credit card. The Owner's account remains active for 12 months from the date of payment.
From the 11th month of validity, PetBioID will send periodic communications to the Owner informing about the approaching expiration and renewal conditions.
7.3 Plan Changes
PetBioID reserves the right to change the resources available in each plan and the values, with prior communication to the Owner with at least 30 days notice.
8. Owner Obligations
The Owner agrees to:
Use the Platform in good faith and in compliance with applicable law
Provide exclusively photographs of the Pet they own or have legal guardianship of
Not register third-party Pets without express authorization from the responsible party
Not use the Platform for illegal, defamatory purposes or that violate third-party rights
Keep their registration data updated
Not perform reverse engineering, decompile or attempt to access the Platform source code
Not use scripts, bots or automated tools to access the Platform
9. Data Processing
During Platform use, PetBioID will collect and store information provided by the Owner, together with automatically generated information, such as access device characteristics, browser, access logs (IP, with date and time), accessed information and geolocation data, which will be stored securely.
Data collected from Owners will be used for the proper provision of services and improvement of the Owner's experience.
The Owner declares to understand, accept and consent that all data collected through the Platform is processed, in accordance with applicable privacy law, by PetBioID or contracted service providers, namely:
Twilio Inc. SMS (OTP) and transactional email sending: twilio.com/legal/privacy
Cloud infrastructure providers, in compliance with applicable law
PetBioID guarantees the Owner, regarding personal data processing, the rights provided by applicable privacy laws, including access, correction, portability, blocking and deletion of data. Requests must be sent to privacy@petbioid.com.
10. Intellectual Property
All materials, patents, trademarks, registrations, domains, names, privileges, creations, images and all related rights connected to the Platform and developed by PetBioID are and will remain the sole and exclusive property of PetBioID.
PetBioID grants the Owner a limited, non-transferable, non-exclusive and revocable license to use the Platform exclusively for the purposes set forth in these Terms.
11. Account Closure
The Owner may close their account at any time, upon request in account settings or by email to contact@petbioid.com.
PetBioID may suspend or close the Owner's account, without prior notice, in the following cases: violation of these Terms, use of the Platform for illegal purposes, provision of false information or acts that harm other users or the Platform.
12. General Provisions
Any clause or condition of this instrument that, for any reason, is deemed null or ineffective will not affect the validity of the remaining provisions of these Terms.
PetBioID's failure to enforce any rights or provisions of these Terms shall not constitute a waiver of such rights.
PetBioID may change this instrument at any time by publishing a revised version at mypetalive.com/terms-of-use. Relevant changes will be communicated by email with at least 15 days notice.
This instrument constitutes the entire understanding between the Owner and PetBioID and is governed by applicable law.
